2. Target group
The online store is targeted both to private as well as corporate clients. The service provider owns all rights to the content of the service.
3. Product orders and contract formation
Product orders are made in the online store by adding the desired product(s) to the shopping cart and confirming the order at the Checkout. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process. Making orders in the online store requires that you provide us with a valid e-mail address. A contract is concluded when Fair Start confirms the order by e-mail.
The confirmation includes the price and the costs of delivery of the order, the ordered products, as well as other information required by applicable mandatory legislation. The service provider reserves the right to not accept the order.
By ordering products in our online store, the customer accepts these terms of service. The customer is also responsible of all orders and payments made in the online store and is responsible for keeping this information intact.
4. Product prices
The prices only apply to orders made in this online store. All prices are in euros and inclusive of value added tax and delivery fee within Finland. VAT is also included in prices for products ordered within the EU.
For deliveries outside of EU, the customer is responsible to pay value added tax, customs duties and any other similar costs of delivery. Delivery fees outside of Finland are charged according to product dimensions and receiving country. The price will be communicated to the customer prior to order.
Fair Start reserves the right to change the prices and the delivery costs applied to the online store, provided that any changes shall only apply to orders made after the entry into force of such changes.
5. Shipping and handling
We will ship the product(s) ordered from the online store without undue delay after we have confirmed the order, and in any event we use reasonable efforts to ship products(s) within thirty (30) days of the confirmation. In the event a product you have ordered is not available, we may separately agree with you that we will deliver another product that is essentially similar to the original product, provided that the price of the replacement product does not exceed that of the original product.
We use Finnish Posti’s delivery options for our deliveries within Finland. The prices vary depending on the size of the package. The delivery price is added to the product price. Delivery time depends on the availability of the product. For off-the-shelf products, an average delivery time within Finland is 5-10 business days, but during sale and other seasonal campaigns it can be longer. National deliveries can be made only to mainland Finland. We do not deliver to Åland Islands.
The service provider is not responsible for delays in case of a force majeure. The service provider reserves the right to ship products separately when applicable.
For international deliveries, please contact our customer support at firstname.lastname@example.org For international deliveries we may use different options upon agreement with the customer. The prices and delivery times will then be defined by our agreement with the third party delivery service.
Products cannot be delivered to the following territories, which do not apply EU Value Added Tax regime: In Germany, Büsingen und Helgoland, in the United Kingdom, Guernsey (e.g. Alderney and Sark, Jersey and Gibraltar, in Italy Livigno and Campione d’Italia, and in Spain the Canary Islands, Ceuta and Melilla. We also do not deliver to Greenland and Faroe Islands.
Products may also be picked up and paid at our office at Liisankatu 8, 00170 Helsinki at an agreed time. Payments can be made in cash and credit/debit card. Please contact email@example.com to inform us about a pickup. State your order number in the email. In this case the shipping cost will be deducted from the price.
The customer bears the risk of damage or loss of the products ordered when the product has been delivered. Do not accept the shipment, if the packaging appears to be damaged.
6. Methods of Payment
Momentarily the only option of payment in our online store is an invoice. The customer will receive an invoice to the email they have specified in the order process. Upon receiving the invoice, the customer then has 14 days to pay. Any delays will result in a claim of interest and expenses as per the Finnish law.
All sales made through the online store are classified as a distance sale contract in accordance with applicable Finnish consumer legislation. The customer has a right to cancel his/her distance sale contract by notifying Fair Start within fourteen (14) days after receiving the ordered products. The right to cancel does not apply to any custom-made or customized products. The product needs to be unused, in the same condition as received, and include all parts belonging to the product. The product needs to be in its original package or otherwise stored in a similar manner. After canceling the order the customer has 14 days to return the product.
When the customer returns a product, and unless otherwise agreed, Fair Start shall return the respective payment, excluding the costs of delivery, by using the same method of payment as used by the customer when making the original transaction (invoice). Products ordered in the online store may not be exchanged directly for other products. Fair Start will not reimburse any value added taxes, customs duties or handling fees paid in shipments outside EU. The re-payment is exclusive of any additional costs of delivery incurred by customer in choosing another method of delivery rather than Fair Start’s standard delivery.
8. Limitations of Liability
To the extent permitted by applicable mandatory legislation, Fair Start shall not be liable for any economic losses, loss of income, loss of profits, loss of contracts, business or anticipated savings, loss of goodwill, or reputation or special or punitive losses, nor any consequential or other indirect damage. This liability exclusion does not apply in cases of gross negligence or unlawful intent and does not apply to the liability of the seller for death or personal injury caused by the goods to any person or where has been a breach of a fundamental contractual obligation. To the extent permitted by applicable mandatory legislation, there are no warranties, conditions or other terms binding on Fair Start other than those mentioned in these general terms.
9. Product Defects
In the event the customer notices that a product bought from the online store is defective, as defined in applicable consumer legislation, the customer should immediately contact firstname.lastname@example.org for compensation. Fair Start is liable for any costs of delivery caused by return(s) of such defective products.
When a product subject to a claim is returned and the claim is substantiated, Fair Start shall credit to the customer the compensation required by applicable consumer legislation.
Fair Start does not guarantee the availability of the products in the online store. Fair Start is not liable for any spelling mistakes or incorrect pictures presented in the online store, nor for incorrect prices, nor for incorrect information regarding any product’s stock situation. In the event a product ordered by a customer has been given an incorrect price, Fair Start shall notify the respective customer of the same prior to an order confirmation and freeze the order until the customer has accepted the new price. All pictures and photos presented in the online store are only to be referred to as examples and they may not be relied upon in any way, including in relation to the amount, appearance, functionality or origin of the respective product(s). Fair Start is not liable for any information provided by third parties.
10. Force Majeure
Unless otherwise required by applicable mandatory legislation, Fair Start shall not be liable for any delays or defects that are beyond their control. These include with-out limitation industrial actions, acts of war and terrorism, fire, lightning, changes in applicable mandatory legislation, technical problems, interruptions in power/telecommunications/computer systems or other communication, as well as delays or defects in services provided by sub-contractors caused by the aforesaid. In the event of such situation, Fair Start shall notify the customer when it starts and when it ends. If the situation has lasted for more than two (2) months, both the customer and Fair Start are entitled to cancel the order made in the web shop with immediate effect.
11. Changes to the General Terms
Fair Start reserves the right to change these general terms at any time. All changes to these general terms are published in the online store. The changes shall enter into force when the customer has accepted the general terms (when making a new purchase or when surfing on the online store) and in any event after thirty (30) days of their publication. We recommend that the customer visit the online store regularly to gain information on any changes to these general terms.
In the event a competent court, authority or arbitral tribunal rules that any section or term of these general terms is fully or partially invalid or unenforceable, the remainder of such section or term and all other sections and terms of these general terms shall remain valid and enforceable to the largest extent allowed by applicable mandatory legislation. All sections or terms that are held to be invalid or unenforceable shall be replaced by similar valid and enforceable sections and terms.
13. Applicable law and Dispute Resolution
All disputes arising out of or relating to these general terms, the online store or purchases made in the online store shall be primarily settled by negotiations with Fair Start’s customer service, and finally by a competent court as determined by applicable mandatory legislation. In the event of disputes, Fair Start aims to follow any decisions of the Finnish Consumer Complaint Board.
The legislation applied to these general terms shall be determined in accordance with applicable mandatory legislation. Unless otherwise stipulated by applicable mandatory legislation, these general terms shall be subject to the laws of Finland and any disputes arising out of or relating to these general terms shall be settled by the courts of Finland.
